Resolution 2025-1
Title: Protecting Property and Opposing New County Building Codes
Sponsored by: Benewah County Republican Central Committee
Status: Passed unanimously 1-14-2025
Whereas the right to own and protect property is an inalienable right given to free men by God and outlined in Article 1 Section 1 of the Idaho State Constitution.
Whereas the primary role of government is to protect the people’s inalienable rights as stated in Article 1 Section 2 of the Idaho State Constitution.
Whereas asking the government for permission to utilize one’s property for building structures for habitation or other purposes violates the God given inalienable right to property.
Whereas counties in Idaho, such as Idaho County do not require any building permits from the county for structures on private property.
Whereas the city of St Maries has made it uneconomical and undesirable to do business or live in the City of St Maries due to their increased building codes and property rights violations.
Whereas in 2014, the free people of Benewah County made it abundantly clear to the County Commissioners that they did not want zoning in Benewah County.
Therefore, be it resolved that the Benewah County Republican Central Committee requests that the Benewah County Commissioners do not further violate the people’s God given inalienable right to property by adding anything additional to the building code or permit process.
Be it resolved that the Benewah County Republican Central Committee requests that the Benewah County Commissioners protect the God given, inalienable right to property and repeal the existing building code.
Be it resolved that the Benewah County Republican Central Committee requests that the people of Benewah County contact commissioners (Bob Short, Phil Lampert and Mark Reynolds) immediately and ask them to uphold the Idaho State Constitution as they swore to do and not add zoning or anything to the existing building code and permit process.
Be it resolved that the Benewah County Republican Central Committee requests that the residents of Benewah County to attend the next county commissioner’s meeting on January 27th, 2025 and comment on this issue.
